The deputy who wanted to charge him with criminal damage for opening his door seemed like a chooch. He really got suckered in by the couple who didn't want to merge correctly.
I agree the deputy seemed to be reading a lot into the video, ironically the lady said she started the video AFTER he hit the car twice, so even if we believe every word out of her mouth, the video shows him talking, but not hitting the truck because he already had.
Now the original incorrect merger was the pickup driver, who admitted he was centered between lanes because the merge was coming up. That's not how merges work. You should be filling both lanes all the way to the end and zipper in. If you merge earlier, you have to have control of your ego because people can legally pass you.
Exactly, he felt bad for those “Kids” it’s not about any of that though. It’s about what evidence you have and what you can prove in court, other officers did a great job keeping their emotions out of it.

@ED-es2qv I totally agree that the proper merge procedure involves picking one lane and then moving ahead to do a zipper merge... but if I'm behind someone who is coming up to a point where you are able to see the lane ends, and they are in the middle of the two lanes occupying both of them, then the last thing I'm going to try and do is attempt to make my way around them and try to get ahead just before the lane ends. That was what I feel like made the 911 callers irresponsible. The only time I'm merging is when the cars in front of me or behind me are in set in their lanes, so I know I'm going to fit in between them. It might be because they're younger or want to drive faster, so it sounds like they wanted to be ahead of the vehicles around them before the merge and the pickup truck was partially blocking the lane they were in, yet they still decided to try and force their way in front of it.

@@jimmyohara2601 The "other cop" in this case was the one that stayed with the initial couple to get their story. The problem is that he only heard their side of the story, so he heavily favored what the initial couple said. This left him in the mindset of "those other guys aggressively attacked this vehicle and pulled a gun on these normal people," which resulted in him trying to phrase things to maximize punishment for the other guys.

Right, that’s what I was saying. I was literally yelling at my phone to the officer with the “children” if they are so scared why follow them home. The man in the video in my opinion did not intentionally open his car door and hit their car, maybe they should not have gotten so close to them to start an altercation because they don’t know the meaning of merge lanes. I’m glad this case got dropped because I was pissed when the one officer was trying to rack up charges. The wife ok, honestly most people will go to jail for doing what she did, so she got lucky. The young adults should have definitely got arrested or a ticket for lying saying a man pulled a gun on them when they pulled up to their home. The cops with the man arrested clearly agrees that he would have done the same thing if you follow me home after a road rage incident. Guys just be safe, respectful, learn the driving laws, don’t lie to get others arrested and just be kind. Just keep driving and don’t engage, I get upset and will cuss you out in my vehicle to myself. But never would I start a road rage incident or finish. All love ❤️

I have 12 years running a gang unit as a parole officer. He’s been out two years with no problems. I’m not violating him. This whole situation cast enough doubt that even the experienced officers have hesitation. The mess on his truck why didn’t the other people get cited for vandalism?

Yup a lot of police unfortunately take one parties side and run with it, when they are supposed to be neutral, they clearly took the people in the red cars side since they called even though both seem pretty at fault for this. Only person that should have been charged was maybe the guys wife that knocked the girls phone out of her hand . Other than that, I don’t see much else.

@@Antonio-ys5zd Just a guess, I'm no LE, but perhaps they included those charges in the case that he was found guilty of the damage to the car - because (again, if it had happened) that would also mean a charge of battery for each of the two occupants of the red car.
To be clear, I don't think he deserved that, as the video didn't prove that he was indeed trying to hit them. Everyone was in the wrong, on different levels for different reasons, in my lay opinion. Red car may have been legally wrong to force their way in, and then start peppering the truck with items. The fiancee jumping out and throwing hands with someone though, and being recorded doing it, just stupid. There's proof, and both of them in the truck got harsh treatment because their reaction was caught on video. Didn't we learn on the playground, it's not who throws the first punch, it's who gets caught retaliating? Classic case here.

His initial jail charges were rough, and you have to be somewhat of an aggressive person to get those. However, for him to have that history of aggression yet later to be pushing yourself for an honest life, that needs to be recognized.

What I found shocking was that initially, they intended to search the house and truck without a warrant and without consent. Even though the parolee gave consent (and kudos for him for that), they were going right onto private property in complete violation of the 4th amendment. And one officer said, "If you don't give us consent, we will tow your vehicle". Why hasn't anyone else in the comments called that out? That's not at all how the law works.

Deputy Houston badge number 116 is a big part of the reason so many people hate the police. He just wanted to “violate” him so bad it’s unreal. If a prosecutor no longer want to persue a case, they are supposed to ask for the charges to be dismissed. Simply not showing up is unprofessional and just wastes everyone's time. If I was the judge, I would have been pissed.

A firearm came out at an altercation involving a parolee. It wasn’t his though. They wouldn’t have followed him home had it been his. It was the old man’s next door. Add to that the fact that he has a wife with an attitude. She took up the girl side of it, and flat went at ole girl sitting in her car. It’s not fair, and if I was still working, I wouldn’t have called his PO. The attorney didn’t like it either. That’s why he didn’t show. Case closed, go home, and good on him for making that decision.
I have never been so on the edge of my seat, waiting to hear what happened. I am so glad that it was dismissed and that he was able to move on with his life. The cop that pushed this forward was so unreasonable and unbothered by ruining this man’s life over something so petty. shame on him.

That rookie could have really ruined that dudes life. The person who actually committed a crime was charged properly, but 2 marks on a car door, that wasn't actually recorded because the phone was in the floorboards, is not worth potentially giving someone a life sentence.
Well he did commit kidnapping and murder, so he kinda ruined his own life by putting himself in these circumstances. Maybe don't put yourself in situations where your parole can be revoked.

He was charged with kidnapping, burglary (and with a deadly), and a 2nd degree murder.
He was found guilty of burglary and the 2nd degree murder.
So whether or not the kidnapping happened was dropped by the court. There's a whole list of reasons as to why that could have been the case. More than likely, it was due to lack of evidence since kidnapping is a pretty high up on the list and wouldn't have been dropped lightly.
Now, legally, he wasn't found guilty of kidnapping. Whether he did or didn't in reality is another question.
Regardless, burglary and 2nd degree. And he's been paying the time and seems to have been pretty exceptional with what he's been doing with his life since.
Now, in this situation, he very well could have had his parole effected due to his actions. Though can't help but sympathize with him in this situation. He neither initiated nor escalated the situation (his wife maybe). And the younger couple were antagonistic.

I’m pro law enforcement and I can honestly say. The type of person that would be so biased as to try and stack charges needs a new profession. This is the kind of person that gets other solid officers hurt. Believe me I’ve worked with the type. Most times they get run off and bounce from department to department until they’re fired for misconduct.

I think the cop who insisted on violating Malachi was already biased because he knew Malachi was a convict. I had a former partner who was jerked around through his parole. He got five years in prison and 9 years parole for a weed violation. Weed. They would pull stuff all the time. One time, they claimed the apartment we were renting was suddenly unsuitable (we didn't have kids around, no weapons, no other violating features). They told him he needed to find suitable housing by Monday. They told him this on Friday. He had three days to find housing that didn't have felons within a specific radius (we live on the Mexican border in Texas: that's a massive ask). No kids on the premises or complex, if an apartment building. Things like that. Luckily, his uncle was able to take him in. The messed up part is his parole was from the state of Idaho. Texas was his auxiliary parole as he got permission to move here with his mother to help him after prison. The parole board leader is massively racist. They tried to claim he was cartel because he's Hispanic. It was horrible. He ended up a heart condition, a stroke, and other massive health issues from the intense stress before he turned 40. Their types of bad actors affect everyone around them, not the just the parolees they want to torture....
The sad thing was, is that the state of Texas' parole board filed complaints against Idaho for how he was being handled by them. However, since he was originally Idaho's "problem," there wasn't much that could be done, as they were still his main authority. Idaho gouges the hell out their parolees too, financially. It's $120-150/month for the "babysitting" fee parolees pay in Idaho. In Texas, it was $20-30 tops. This was when he was on parole several years ago, though. I don't know if that's changed since. They charged several hundred for copies of court paperwork and to submit court documents for cases. It's literally extortion. Not to mention, Idaho had a 100% privatized prison system until extremely recently. If that isn't outright incentive to arrest, charge, then violate, I don't what is. My partner ended up having to do his 9 year parole over again at the very end of the first one because they "didn't like how he did it," despite never violating him for supposedly doing something wrong, never bringing it up that he did anything wrong, etc. We ended up parting ways a few years ago when he ended up going to a work camp when COVID started.
Our prison system is an extremely thinly veiled cover for legal slavery these days. It really is. Don't forget that many states put your charges on your record forever, with no deadline to take it off after good behavior or anything. So you're not only paying the huge monthly fees, surviving, and then enormous like $13,000 "reparations" payment annually, but you can't find work, easily rent or buy a place, and do anything else an adult needs to to survive and improve their place in the world. It's on purpose for sure.

I can't stand how authorities take advantage of some people who are genuinely trying to do better and then let off those who need a lesson taught to them. This really irked me. I figured I'd share some experiences to add to your point in case anyone wanted specific examples of how the system abuses its prisoners.

That’s what we call a bias cop, and one that doesn’t like to be told that he’s doing his job wrong. He was probably pissed multiple cops went to one scene and he was the only cop at the other. You can tell no one likes him in that department because of the faces they made when he kept rambling on about what charges he would give the other guy. That’s why they said “so your taking initial?” Because they knew it would be dropped. That cop made a stupid decision to be the “right” cop and unfortunately ended up looking like the jerk.

As a parolee and someone who spent their whole adult life in and never thought id get out i really sympathize with malachi here. Its hard to remember when someone is antagonizing you that you have less rights and you need to walk away asap this was an extremely close call to his whole life being thrown away over one officer being a dick after a dickhead couple started some shit but also his gf is a loose cannon and needs to understand whatever someone says or does unless they physically hurt you or threaten your life you dont have a right to put hands on someone first. Thats criminal. Even if they do hurt you its better to walk away because the winner of a fight is often charged with battery.
So what I've learned from this situation is that it's legal to throw drinks at other motorists. What a great example these officers have made for the community. Also, not only does it look like he obviously didn't hit their car but charging him with two counts of battery is ludicrous when he never even got out of the vehicle.

If the other officers collectively have the same reaction to what the initial officer wants to charge Malachi (owner of the Blue Truck), they should've stepped in and tried to stop it, but they chose not to. I understand their hesitation and reluctance, but as officers there's an expectation of them being fair and just, as well as those who are entrusted to uphold the law. It's events like this, that unfortunately cause people to be weary of police, or just hate them.

This is scary. Imagine you’re doing your best to be a better person in life despite your past, and it just takes one irresponsible person to hold you at their mercy a destroy everything you have worked for. I was genuinely in fear for this guy’s life and he was doing so well too. I’m happy this didn’t escalate badly for him
That young cop was 100% in the wrong to charge that dude. The people in the red car needed to be arrested too.
Everything they said outside of the video was lies, and you can hear the cans hitting his truck. I bet they made the marks on the door while they were waiting for the cops.
@Floridaman1780_ yeah bc there was nothing in that video to show he intentionally hit their car or that he even hit it at all to be honest. And the rookie said "he had no reason to open his car door on the roadway," but he 100% did have a reason considering he was blocked in the roadway and unable to leave the scene.
I hated that he was like, "These guys in the red car are young, like 20." as if it was an excuse, even after they talk about someone pointing a gun at them, which was a lie.
Agreed 100%. The young cop completely overreacted, and the red car’s actions shouldn’t have been ignored either.

Considering this little incident, I’m really proud of this guy for turning his life around! Has a good job, bought a home, has two vehicles, and is raising four kids? I’d say he’s actually trying to do good in his life now! RIP to his victim.

Me too. He got really lucky on this one to skate by, particularly when they were trying to revoke his probation. Hopefully he can stay out of trouble for the last two years
@stretchedapart he is clearly still a violent person. Prison doesn't reform you. It teaches you how to intimidate others, extort, smuggle drugs. And to react with violence towards others.
Probation is such a failed system. This guy is the victim of a road rage incident and the cop wants to violate him because he is on probation, that is so failed. This guy gets his life turned around and the cop wants to keep him in the system. Charge the other couple for what they did, throwing something at his vehicle and making a false report of a gun after they followed him home.

@@davidcollin1436 True but the PO didn't need to revoke and have him arrested. He could have had interviewed the cop and watched the videos first. If he determined Malachi was in violation, then a bench warrant could have been issued. He shouldn't have had to go through such a high risk situation.

A few years ago, my wife got into a road rage incident where someone was following her. She led them straight to our apartment. I told her never do that. Go someplace public, go to the gas station or to the grocery store. Make a right turn somewhere put some distance between you and them. Why risk having a MF come back after hours and slashing your tires?
Yeah .......call 911.....say u are driving past the police station.....describe your car and the one following u .....probably the following car won't follow u to the station but a cruiser can make traffic stop and find out what's going on. This way police have a record of the occupants in the car and if any thing happens in the future they have suspects .....

Ridiculous that the red car wasn't charged with something, they started the incident, followed them home, made a false report.. and just allowed to leave. And even more ridiculous that the young cop was so eager to ruin Malachi's life with no evidence of any wrongdoing.
Deputy Houston badge number 116 should be investigated. He clearly can not make unbiased decisions.

I’m glad it worked out in this guy’s favor, but that officer really wanted to stick it to him and made him jump through a bunch of hoops to get this outcome. This is what’s wrong with our justice system. There are some criminals who never learn their lesson, but this gentleman wasn’t one of them.
